1. About this policy
This Privacy Policy explains how Silo Sales and Marketing Pty Ltd ("we", "us", "our") collects, holds, uses and discloses personal information in connection with The Gateway, Campbelltown, a mixed-use development at 6 Grange Road, Leumeah NSW 2560, and the website www.thegatewaycampbelltown.com.au.
It applies to anyone who visits our website, makes an enquiry, registers interest, buys or leases a lot, or otherwise deals with us. This includes prospective purchasers, investors (including SMSF trustees), owner-occupiers, prospective tenants, suppliers, contractors, media and community members.
We handle personal information in line with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs). We also comply with the Spam Act 2003 (Cth), the Do Not Call Register Act 2006 (Cth), the Surveillance Devices Act 2007 (NSW) and, where relevant, the Anti-Money Laundering and Counter-Terrorism Financing Act 2006 (Cth).
"Personal information" means information or an opinion about an identified individual, or an individual who is reasonably identifiable.
2. Personal information we collect
We only collect personal information that is reasonably necessary for our business. Depending on how you deal with us, this may include:
Contact details: name, phone number, email address, postal address and preferred contact method.
Enquiry details: the type of space you are interested in (storage, office, allied health, café, childcare), whether you are buying or leasing, your budget, timing and how you heard about us.
Purchaser and investor details: the name of any company, trust or self-managed super fund you are buying through, your role in that entity, and details of your solicitor, conveyancer, accountant or finance broker
Business details for tenants: business name, ABN, the intended use of the premises and referees.
Communications: records of emails, messages, phone calls (including recordings and transcripts where you have been told the call is recorded) and meeting notes.
Website and device information: IP address, browser and device type, pages visited, referring website and similar information collected through cookies and analytics tools (see section 6).
Images: CCTV footage if you visit the site or our sales office, and photographs taken at events (we will tell you if photos are being taken).
We do not intend to collect sensitive information, such as health information. If it is volunteered to us (for example, an accessibility need for an inspection), we will only use it for the purpose it was given and with your consent.
The Gateway website is not directed at people under 18, and we do not knowingly collect personal information from children.
3. How we collect it
Where practicable, we collect personal information directly from you, including when you:
complete the contact or enquiry form on our website;
call, email, text or message us, including through social media or property listing platforms;
attend an inspection, display suite, event or meeting;
sign a contract, expression of interest, lease or other document.
We may also collect personal information from third parties, such as your solicitor, conveyancer, accountant, finance broker or referring agent; property portals and advertising platforms that pass on your enquiry; identity verification providers; and publicly available sources such as ASIC and ABN registers.
If we receive personal information we did not ask for, we will decide whether we could have lawfully collected it. If not, we will destroy or de-identify it where lawful and reasonable to do so.
You can generally choose not to identify yourself, or use a pseudonym, when making a general enquiry. However, we will need your name and contact details to respond properly, and we cannot sell or lease a lot to you without identifying you.
4. Why we collect, hold, use and disclose it
We collect, hold, use and disclose personal information to:
respond to your enquiry and provide information about The Gateway, including floor plans, pricing, availability and construction updates;
arrange inspections, meetings and calls;
assess, prepare and administer contracts of sale, expressions of interest, leases and settlements;
verify identity and meet our legal and regulatory obligations, including anti-money laundering, tax and record-keeping laws;
process deposits, payments and refunds;
coordinate strata, building management, property management and leasing services for purchasers and tenants;
manage site safety and security;
send you marketing about The Gateway and related projects, where permitted (see section 5);
improve our website, marketing and customer service;
manage complaints and disputes, and protect our legal rights.
We will only use or disclose your personal information for another purpose if you consent, if you would reasonably expect it and the purpose is related, or if the law requires or permits it.
If you do not give us the information we ask for, we may not be able to respond to your enquiry, offer you a lot or complete a transaction.
5. Direct marketing
We may use your contact details to send you news, offers and updates about The Gateway and other projects developed or managed by us and our related entities, including Silo Storage. We do this by email, SMS, phone or post.
We will only send commercial electronic messages (email and SMS) with your consent, which may be express (for example, ticking a box on our form) or inferred from our existing relationship, as permitted by the Spam Act 2003. Every message will identify us and include a functioning unsubscribe option.
You can opt out at any time by using the unsubscribe link, replying STOP to an SMS, or contacting us using the details in section 12. We will action your request within 5 business days. We do not sell or rent your personal information to anyone.
6. Cookies, analytics and advertising
Our website is hosted on Squarespace. Like most websites, it uses cookies and similar technologies to make the site work, remember your preferences and understand how visitors use it.
We and our service providers may use:
Essential cookies needed for the website and forms to function and stay secure (including spam protection).
Analytics tools, such as Squarespace Analytics and Google Analytics, which tell us how many people visit, which pages they view and how they found us.
Advertising tools, such as the Meta Pixel and Google Ads, which measure the performance of our ads and show our ads to people who have visited our website or are similar to people who have enquired.
These tools may collect your IP address, device information and browsing activity on our site, and the providers may combine it with other information they hold about you under their own privacy policies.
You can block or delete cookies through your browser settings, and opt out of personalised ads through your Google Ad Settings and Meta ad preferences. Some parts of the website may not work properly if you disable cookies.
7. Phone calls, recordings and automated tools
Calls to and from our sales and leasing teams may be recorded and transcribed for training, quality and record-keeping purposes. We will tell you at the start of the call if it is being recorded. If you do not want the call recorded, let us know and we will offer another way to help.
Some calls and messages may first be answered by an AI assistant, which answers general questions, collects your details and routes your enquiry to the right person. The assistant will tell you it is an AI if you ask, and you can ask to speak with a person at any time.
We also use software, including customer relationship management (CRM) tools, to record and organise enquiries and to prioritise follow-up. These tools help our team decide who to contact first and what information to send. They do not make decisions about whether you can buy or lease a lot, the price you pay, or the terms offered. Those decisions are made by our people.
If we start using a computer program to make, or substantially and directly assist in making, a decision that could significantly affect your rights or interests, we will update this policy to describe the kinds of personal information used and the kinds of decisions made, as required by the APPs from 10 December 2026.
8. Who we disclose it to
We may disclose your personal information, only as needed, to:
our related entities, joint venture partners and their staff involved in The Gateway, including Silo Storage entities that provide sales, leasing, building management and property management services;
sales and leasing agents engaged by us;
our lawyers, conveyancers, accountants, auditors, financiers and insurers;
your own solicitor, conveyancer, accountant, finance broker or financial adviser, where you ask us to or it is needed to complete your transaction;
strata managers and the owners corporation, once a strata plan is registered;
builders, consultants and contractors, where needed to deliver or service your lot;
service providers who support our business, such as website hosting, CRM, email, phone and SMS, AI call-handling, cloud storage, identity verification, payment processing, marketing and advertising providers;
government agencies, regulators, courts and law enforcement, where required or authorised by law (for example, AUSTRAC, the ATO or Revenue NSW).
We require our service providers to handle personal information only for the services they provide to us, and to keep it secure.
Overseas disclosure
Some of our service providers store or process information outside Australia. These include providers of website hosting, CRM, email, cloud storage, call-handling and advertising services, whose servers may be located in the United States, the European Union, the United Kingdom and other countries where those providers or their sub-processors operate. We take reasonable steps to ensure overseas recipients handle your personal information consistently with the APPs.
9. Identity verification and anti-money laundering
When you buy a lot from us, we may be required under the Anti-Money Laundering and Counter-Terrorism Financing Act 2006 (Cth) to verify your identity and that of any company, trust or SMSF you are buying through, including its directors, trustees and beneficial owners. We may also need to ask about the source of the funds used.
We may use an identity verification service to check your details against government and other records, such as the Document Verification Service. We will ask for your consent before doing so, or offer you another way to verify.
We keep this information for as long as the law requires (generally at least 7 years after the transaction). We may be required to report certain transactions or suspicious matters to AUSTRAC, and the law may prevent us from telling you that a report has been made.
10. Security, retention and data breaches
We hold personal information in electronic records, cloud-based systems and, occasionally, paper files. We take reasonable steps to protect it from misuse, interference, loss and unauthorised access, modification or disclosure. These include access controls, multi-factor authentication, staff confidentiality obligations, secure storage of paper files and limiting access to people who need it.
No method of transmitting or storing information is completely secure, and we cannot guarantee the security of information you send us online.
We keep personal information only for as long as we need it for the purposes in this policy or as required by law, including tax, contract and anti-money laundering record-keeping laws. When it is no longer needed, we take reasonable steps to destroy or de-identify it.
If we experience a data breach that is likely to result in serious harm to you, we will notify you and the Office of the Australian Information Commissioner (OAIC) in line with the Notifiable Data Breaches scheme.
11. Access and correction
You can ask to access the personal information we hold about you, or ask us to correct it if it is inaccurate, out of date, incomplete, irrelevant or misleading. Contact us using the details in section 12.
We will respond within 30 days. We may need to verify your identity first. We do not charge for making a request, but may charge a reasonable fee for the cost of providing access to large volumes of records, and we will tell you before we do.
If we refuse access or correction, we will tell you why in writing (unless it would be unreasonable to do so) and how to complain. If we refuse a correction, you can ask us to attach a statement to your record noting that you believe it is wrong.
12. Complaints, changes and contact us
If you have a question or complaint about how we handle your personal information, please contact our Privacy Officer in writing. We will acknowledge your complaint within 7 days and aim to resolve it within 30 days.
If you are not satisfied with our response, you can complain to the Office of the Australian Information Commissioner (OAIC) at www.oaic.gov.au or on 1300 363 992.
We may update this policy from time to time. The current version will always be published on this page, with the date it was last updated. A free copy is available in another form on request.
